Pursuant to article 13 of the EU regulation n. 2016/679, also known as the General Data Protection Regulation (hence forth referred to as “GDPR”), MadMax Nautical Franchising Srl, informs you that its personal data (hence forth referred to as “Data”), will be used in accordance with the rules as set out by the GDPR and each applicable regulation with regard to personal data use in accordance with the information that follows.

1.Owner of Data use. Responsible for protection of the Data.

The Owner of the use of data is MadMax Nautical Franchising Srl, with legal premises in Via Aurelio Lampredi, 81 – 57121 Livorno – Italy (hence forth referred to as “Owner”). The Owner responsible for the protection of Data can be contacted at the following e-mail address; info@madmaxcharter.it for information regarding the use of Data.

2. Data categories

Data used by the Owner includes: (i) personal data (name, surname, age, sex), professional training (qualifications, number used on professional register), permanent address or current address and contacts (telephone, e-mail address).

3.Purpose and legal basis of Data use. Legitimate interest.

The Data is used to analyze the traffic on the website, pursuant article 6, subsection 1, letters b)  and c) of the GDPR, as well as the legitimate interest of the Owner to article 6, subsection 1, letter f) of the GDPR in reference to:

  1. The promotion of its business of catamaran rental with skipper (weekly holidays), of Nautical Franchising (purchase of vessels and inclusion in the MadMax group) and of the school for skippers;
  2. the dispatch of commercial and promotional information relative to the Owners business activities, as well as surveys and research toward individuals who have previously shown interest in the Owners business.

In any event, the use of its Data carried out on the basis that the Owners legitimate interest occurs, not only pursuant article 6, subsection 1, letter f) of the GDPR but also in conformity with n. 47 and Opinion n.6/2014 Article 29 Data Protection Working Party, paragraph. III.3.1

4. Method of Data use.

Your Data is collected and recorded in a lawful manner for the reasons indicated above, and handled using electronic and automated systems, including their being added to our data bank, in conformity with the rules outlined by the GDPR regarding Data security, and in any case in such a way to guarantee the security and privacy of the Data.

5. Recipient or Recipient categories.

The Data can be made available, shown to or shared with the following recipients, who will be nominated by the Owner, case by case, based on their responsibilities, the list being available at the Owners head office, or that of his appointed staff:

  • Commercial Representatives, employees or collaborators as nominated by the Owner
  • private of public officials, natural or juridical persons, whom the Owner uses for the performance of the instrumental activities to achieve the aforementioned purpose or to which the Owner is required to communicate the Data pursuant to legal or contractual obligations.

In any event the Data will not be shared.

6. Redention period

The Data will be kept for a period of time not exceeding 10 (ten) years for information purposes and, in any case, for the time strictly necessary for the pursuit of the legitimate interest of the Owner

7. Access rights, cancellation, limitation and portability

The Data Controller informs you that the rights referred to in Articles from 15 to 20 of the GDPR. By way of example, by sending a specific request to the email address info@madmaxcharter.it, you can:

  1. obtain confirmation that personal data processing is being processed;

  2. if a treatment is in progress, obtain access to the data and information relating to the treatment, as well as request a copy of the data;

  5. obtain, in the cases provided for by art. 18 of the GDPR, the limitation of the processing of data concerning you;

  6. receive the Data concerning you in a structured format, commonly used and readable by an automatic device and request their transmission to another holder, if technically feasible.

8.  Right to object.

Pursuant to art. 21 of the GDPR, you will also enjoy the right to object at any time to the processing of your data carried out for the pursuit of the legitimate interest of the owner by writing to the email address info@madmaxcharter.it. In the event of opposition, the Data will no longer be processed, provided that there are no legitimate reasons to proceed with the processing that prevail over the interests, rights and freedoms of the interested parties, or for the assessment, exercise or defense of a right in court.

9. Right to lodge a complaint with the Guarantor.
